Welcome to Clinical Hero. These Terms and Conditions (“Terms”) govern your access to and use of the website located at www.clinicalherostudies.com, any related webpages, forms, landing pages, text message programs, email communications, referral links, Ambassador Program materials, and any other services offered by BAM Wellness Corporation d/b/a Clinical Hero (“Clinical Hero,” “we,” “us,” or “our”). 

By accessing or using Clinical Hero, submitting information, clicking a link, opting into communications, applying for a study, participating in the Clinical Hero Ambassador Program, or otherwise interacting with Clinical Hero, you agree to these Terms. If you do not agree, you must not use Clinical Hero. 

1. Purpose of Clinical Hero

Clinical Hero is a marketing, referral, education, and information platform designed to help connect individuals with third-party clinical research studies, clinical trials, paid research opportunities, health-related services, wellness offers, and other third-party opportunities. 

Clinical Hero does not conduct, sponsor, administer, supervise, approve, or manage clinical trials or research studies. Clinical Hero does not provide medical care, medical advice, diagnosis, treatment, or healthcare services. 

Clinical Hero may collect information from users who are interested in participating in clinical research studies or related opportunities and may share that information with third-party clinical research sites, sponsors, contract research organizations, study vendors, service providers, or other authorized third parties who may contact the user regarding potential eligibility, screening, participation, or related opportunities. 

Clinical Hero acts solely as an intermediary. Submission of information through Clinical Hero does not guarantee that you will be contacted, screened, accepted, enrolled, compensated, or allowed to participate in any study, program, service, or opportunity. 

2. No Medical Advice

All information provided by Clinical Hero, including information on our website, in advertisements, through text messages, emails, social media posts, Ambassador communications, blog posts, landing pages, affiliate links, or third-party offers, is provided for general informational and marketing purposes only. 

Clinical Hero does not provide medical advice, diagnosis, treatment, professional healthcare services, or recommendations concerning any medical condition, product, service, treatment, clinical trial, diagnostic test, supplement, wellness program, or healthcare provider. 

You should consult with a qualified healthcare provider before making any healthcare decision, participating in a clinical trial, using any health or wellness product or service, purchasing any diagnostic or lab service, or changing any medical, fitness, nutrition, or wellness routine. 

3. User Eligibility

By using Clinical Hero, you represent and warrant that: 

• You are at least 18 years old; 

• You have the legal capacity to agree to these Terms; 

• The information you provide is accurate, complete, and current; 

• You are using Clinical Hero for lawful purposes only; 

• You are not submitting information on behalf of another person without proper authorization. 

Clinical Hero may refuse, reject, remove, or decline to forward any submission at any time and for any reason. 

4. Information Collection, Use, and Sharing

Clinical Hero may collect information that you voluntarily provide, including but not limited to your name, email address, phone number, location, demographic information, health-related information, study interest, screening responses, and communication preferences. 

Clinical Hero may use this information to: 

• Contact you about clinical research studies or related opportunities; 

• Determine whether you may be a potential match for a study or opportunity; 

• Share your information with third-party research sites, sponsors, CROs, study vendors, laboratories, health-related providers, affiliate partners, or other third parties connected to the opportunity you expressed interest in; 

• Send you information by email, SMS, phone, online messaging, or other communication channels; 

• Operate, improve, analyze, and measure Clinical Hero’s marketing, referral, and Ambassador programs; 

• Comply with legal, regulatory, contractual, and business obligations. 

Clinical Hero may use third-party service providers, including technology providers, AI tools, form providers, email providers, SMS platforms, analytics tools, affiliate tracking platforms, and customer relationship management systems. 

Please review our Privacy Policy for more information about how we collect, use, share, and protect personal information. 

5. Third-Party Studies, Providers, Products, and Services

Clinical Hero may refer, route, introduce, or link users to third-party studies, websites, products, services, providers, laboratories, telehealth companies, wellness companies, fitness programs, nutrition programs, health-related offers, or other opportunities. 

All such third-party studies, products, services, and opportunities are provided by independent third parties. Clinical Hero does not own, control, operate, supervise, or guarantee any third-party study, product, service, website, provider, or opportunity. 

Clinical Hero is not responsible for: 

• The design, conduct, safety, quality, legality, availability, or outcome of any clinical trial or research study; 

• Any eligibility, screening, enrollment, compensation, medical, scheduling, or participation decision made by any third party; 

• Any third-party product, service, claim, representation, warranty, advertisement, communication, or offer; 

• Any injury, illness, adverse event, loss, death, damage, disappointment, or expense related to any third-party study, product, service, provider, or opportunity; 

• Any third-party website, privacy policy, terms, security practice, payment process, refund policy, or customer service practice. 

Your decision to engage with any third party is made solely at your own discretion and risk. 

6. Affiliate Links, Referral Links, and Compensation Disclosure

Clinical Hero may participate in affiliate marketing, referral, lead generation, performance marketing, sponsored placement, revenue sharing, or similar programs. 

This means Clinical Hero may receive compensation, commissions, referral fees, lead fees, performance payments, or other financial incentives when you: 

• Click on certain links; 

• Submit information through a form; 

• Apply for a study or opportunity; 

• Purchase or use a third-party product or service; 

• Schedule a consultation; 

• Complete a qualifying action; 

• Otherwise engage with a third-party offer. 

Clinical Hero may receive compensation from clinical research sites, sponsors, CROs, laboratories, diagnostic companies, telehealth providers, wellness companies, fitness companies, nutrition companies, technology platforms, affiliate networks, or other third parties. 

The existence of compensation does not mean Clinical Hero endorses, guarantees, recommends, or warrants any third-party product, service, study, company, or opportunity. 

Clinical Hero may choose which opportunities to display, promote, or make available based on business, marketing, financial, operational, or other considerations. 

Tracking, Attribution, and Compensation Determination

Clinical Hero uses proprietary and third-party tracking systems, technologies, and methodologies to measure user activity, referrals, clicks, leads, applications, conversions, and other actions.

You acknowledge and agree that:

• Tracking may rely on cookies, pixels, unique identifiers, URLs, server-side tracking, or other technologies;
• Tracking results may vary due to technical limitations, user behavior, device settings, browser configurations, or third-party system factors;
• Clinical Hero does not guarantee that all actions, clicks, referrals, or conversions will be tracked or credited;
• Clinical Hero may rely on data from third-party partners, networks, or providers to validate whether a lead, referral, or conversion qualifies for compensation;
• In the event of discrepancies between tracking systems, Clinical Hero reserves the right to determine, in its sole discretion, whether a referral or conversion is valid and eligible for compensation;
• Clinical Hero may adjust, deny, reverse, or withhold compensation for any reason, including but not limited to:
  • invalid or duplicate leads
  • unqualified referrals
  • fraudulent or suspicious activity
  • failure of a third party to confirm or pay for a conversion
  • tracking errors or discrepancies

All decisions regarding tracking, attribution, and compensation are final and binding.

Third-Party Tracking and Technology

Clinical Hero may use third-party platforms, tools, and service providers to support tracking, attribution, analytics, communication, and program management.

Clinical Hero is not responsible for:

• errors, delays, or failures in third-party tracking systems
• inaccuracies in third-party reporting
• technical issues beyond its control

7. No Endorsement or Guarantee

The inclusion of any third-party link, study, product, service, provider, partner, advertiser, affiliate offer, or opportunity on Clinical Hero’s website or in Clinical Hero communications does not constitute an endorsement, recommendation, certification, approval, or guarantee by Clinical Hero. 

Clinical Hero does not guarantee: 

• That any third-party product or service is safe, effective, appropriate, or suitable for you; 

• That any study or opportunity is available, accurate, complete, or current; 

• That you will qualify for, be accepted into, enroll in, complete, or receive compensation for any study or opportunity; 

• That any third-party provider will contact you; 

• That any third-party claims are accurate, complete, substantiated, or compliant with law; 

• That any health, wellness, fitness, nutrition, diagnostic, or medical outcome will occur. 

You are responsible for conducting your own review and making your own decisions. 

8. Clinical Hero Ambassador Program

Clinical Hero may operate an Ambassador Program through which individuals may share approved Clinical Hero links, referral opportunities, clinical trial information, health-related offers, or other promotional materials. 

Ambassadors may receive compensation for qualifying referrals, leads, clicks, applications, conversions, sales, enrollments, or other approved actions, as determined solely by Clinical Hero. 

Participation in the Ambassador Program is subject to separate program rules, guidelines, payout terms, compliance requirements, and any Ambassador Agreement provided by Clinical Hero. Clinical Hero may modify, suspend, or terminate the Ambassador Program, any offer, any payout structure, or any Ambassador’s participation at any time. 

Clinical Hero may withhold, deny, reverse, or adjust compensation for any reason, including suspected fraud, duplicate submissions, low-quality leads, nonqualified leads, self-referrals, misleading promotion, noncompliant messaging, violation of program rules, chargebacks, rejected conversions, or failure of a third party to pay Clinical Hero. 

Ambassadors are independent participants and are not employees, agents, franchisees, legal representatives, partners, joint venturers, or contractors of Clinical Hero unless otherwise expressly agreed in writing. 

9. Ambassador and Affiliate Disclosure Requirements

Ambassadors, affiliates, influencers, referral partners, and any other persons promoting Clinical Hero or Clinical Hero-related offers must clearly and conspicuously disclose any material connection to Clinical Hero or any third-party offer when required by law, platform rules, or Clinical Hero policy. 

This includes disclosing when the person may earn compensation for a referral, click, lead, application, sale, or other action. 

Ambassadors must not: 

• Make false, misleading, exaggerated, or unapproved claims; 

• Promise eligibility, enrollment, payment, medical benefit, treatment benefit, or study outcome; 

• State or imply that Clinical Hero conducts or sponsors clinical trials; 

• Provide medical advice; 

• Misrepresent compensation, risks, benefits, time commitment, eligibility, procedures, or study details; 

• Use unapproved advertising copy, images, claims, or testimonials; 

• Target minors or submit information on behalf of others without permission; 

• Violate FTC rules, FDA rules, privacy laws, TCPA rules, platform policies, or any other applicable laws. 

Clinical Hero may require Ambassadors to use only approved content, links, disclosures, scripts, landing pages, or promotional materials. Clinical Hero may remove or restrict any Ambassador at any time. 

10. User Responsibilities

You agree not to: 

• Submit false, misleading, inaccurate, incomplete, fraudulent, or unauthorized information; 

• Submit information for another person without permission; 

• Use Clinical Hero for unlawful, deceptive, abusive, harassing, or fraudulent purposes; 

• Interfere with Clinical Hero’s website, forms, tracking systems, communications, or technology; 

• Attempt to manipulate referrals, tracking, compensation, lead quality, or Ambassador payouts; 

• Violate any applicable law, rule, regulation, or third-party right. 

You are responsible for your own communications, decisions, submissions, and interactions with third parties. 

11. SMS, Email, Phone, and Electronic Communications

By submitting your contact information, you consent to receive communications from Clinical Hero, its service providers, and, where applicable, third parties connected to the opportunity you selected. 

These communications may include emails, phone calls, text messages, automated messages, prerecorded messages, or other electronic communications about clinical trials, research studies, Ambassador opportunities, affiliate offers, health-related opportunities, or related services. 

If you opt in to SMS communications, message frequency may vary. Message and data rates may apply. You may opt out of SMS communications by replying STOP. You may request help by replying HELP or contacting Clinical Hero through the contact information below. 

Carriers are not liable for delayed or undelivered messages. 

Consent to receive marketing communications is not a condition of purchasing any goods or services. 

12. Third-Party Links and Websites

Clinical Hero may contain links to third-party websites, landing pages, applications, affiliate platforms, payment processors, research sites, laboratories, health providers, wellness companies, or other resources. 

Clinical Hero is not responsible for the availability, accuracy, security, privacy practices, content, products, services, terms, policies, or actions of any third-party website or provider. 

You should review the terms and privacy policies of any third party before submitting information, purchasing anything, scheduling any service, or participating in any study. 

13. Intellectual Property

All Clinical Hero names, logos, trademarks, service marks, website content, text, graphics, images, forms, videos, scripts, program materials, Ambassador materials, and other content are owned by or licensed to Clinical Hero, unless otherwise stated. 

You may not copy, modify, reproduce, distribute, display, sell, license, exploit, or use Clinical Hero materials except as expressly authorized by Clinical Hero in writing. 

Ambassadors may use approved Clinical Hero promotional materials only in accordance with Clinical Hero’s rules and may not modify them without permission. 

14. No Warranties

Clinical Hero is provided on an “as is” and “as available” basis. 

To the fullest extent permitted by law, Clinical Hero disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, security, and uninterrupted operation. 

Clinical Hero does not warrant that: 

• The website or services will be uninterrupted, error-free, secure, or available; 

• Any information will be accurate, complete, or current; 

• Any third-party provider will contact you; 

• Any referral, link, lead, application, study, offer, or opportunity will produce any result; 

• Any Ambassador or third party will act lawfully, accurately, or appropriately. 

15. Limitation of Liability

To the fullest extent permitted by law, Clinical Hero, BAM Wellness Corporation, and their respective owners, officers, directors, members, managers, employees, contractors, agents, representatives, affiliates, successors, assigns, vendors, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages of any kind arising out of or related to: 

• Your use of, or inability to use, Clinical Hero; 

• Your submission of information; 

• Your participation or non-participation in any clinical trial, research study, product, service, program, or opportunity; 

• Your interaction with any third-party provider, study site, sponsor, CRO, laboratory, telehealth provider, wellness company, Ambassador, affiliate, advertiser, or referral partner; 

• Any third-party action, omission, communication, claim, decision, product, service, website, or offer; 

• Any injury, illness, adverse event, loss of life, physical harm, emotional distress, financial loss, lost opportunity, data loss, privacy incident, or other harm; 

• Any incorrect, incomplete, outdated, or misleading information; 

• Any failure to qualify for, enroll in, complete, or receive compensation from any study, product, service, or opportunity; 

• Any Ambassador or affiliate content, post, claim, disclosure, referral, or communication; 

• Any unauthorized access to or use of information, except to the extent liability cannot be excluded by law. 

If Clinical Hero is found liable despite these Terms, Clinical Hero’s total cumulative liability shall not exceed one hundred dollars ($100) or the amount you paid directly to Clinical Hero for use of the service giving rise to the claim, whichever is greater. 

16. Indemnification

You agree to defend, indemnify, and hold harmless Clinical Hero, BAM Wellness Corporation, and their respective owners, officers, directors, members, managers, employees, contractors, agents, representatives, affiliates, successors, assigns, vendors, and service providers from and against any claims, demands, actions, damages, losses, liabilities, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: 

• Your use of Clinical Hero; 

• Your violation of these Terms; 

• Your submission of false, misleading, unauthorized, or inaccurate information; 

• Your participation or non-participation in any study, product, service, or opportunity; 

• Your interaction with any third party; 

• Your violation of any law, regulation, rule, or third-party right; 

• Your conduct as an Ambassador, affiliate, influencer, referral partner, or user; 

• Any claim arising from content, statements, links, endorsements, referrals, or communications you create or share. 

17. Right to Modify, Suspend, or Discontinue

Clinical Hero may modify, suspend, restrict, replace, or discontinue any part of the website, services, forms, communications, links, offers, Ambassador Program, payout terms, or third-party opportunities at any time, with or without notice. 

Clinical Hero may update these Terms at any time. Updated Terms are effective when posted. Your continued use of Clinical Hero after updates are posted means you accept the revised Terms. 

18. Termination or Restriction of Access

Clinical Hero may suspend, restrict, or terminate your access to Clinical Hero, your participation in the Ambassador Program, your eligibility for payouts, or your ability to submit information at any time, with or without notice, if Clinical Hero believes you violated these Terms, violated program rules, engaged in fraud, submitted low-quality or invalid leads, misused the platform, or acted in a way that may harm Clinical Hero, users, partners, or third parties. 

19. Compliance With Laws

You agree to comply with all applicable federal, state, and local laws, rules, and regulations, including laws related to advertising, endorsements, privacy, communications, telemarketing, text messaging, healthcare marketing, consumer protection, intellectual property, and unfair or deceptive practices. 

Ambassadors and affiliates are solely responsible for ensuring that their promotional activities comply with applicable laws and platform rules. 

20. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. 

Any dispute arising out of or related to these Terms, Clinical Hero, or your use of Clinical Hero shall be brought exclusively in the state or federal courts located in Broward County, Florida, unless otherwise required by applicable law. You consent to the personal jurisdiction and venue of those courts. 

21. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect. 

22. Entire Agreement

These Terms, together with the Privacy Policy, HIPAA Policy, Text Communications Policy, Ambassador Program rules, and any other written terms provided by Clinical Hero, constitute the entire agreement between you and Clinical Hero regarding your use of Clinical Hero.
